Terms of Service

By accessing or using the PageBrain desktop application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). PageBrain is a product of SearchMoat LLC ("we", "us", or "our"). If you do not agree, do not use the Service.

PageBrain is a local-first desktop application for website crawling, technical SEO auditing, and AI-powered analysis. The Service includes both free and paid tiers, each with different feature sets and usage limits as described on our pricing page.

Some features require an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@pagebrain.app if you suspect unauthorised access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Paid plans are billed on a recurring basis (monthly or annual) as selected at checkout. By subscribing you authorise us to charge your payment method on each renewal date. Billing is processed by SearchMoat LLC.

• Free tier - available indefinitely with no payment required. Feature set may change over time.
• Upgrades & downgrades - take effect at the start of your next billing cycle.
• Cancellation - you may cancel at any time from your account settings. Access continues until the end of the current billing period.
• Refunds - we offer a 14-day refund policy from the date of initial purchase. Contact support@pagebrain.app for requests.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the application.
• Interfere with or disrupt the Service or its infrastructure.
• Resell, sublicence, or redistribute access to the Service without written permission.
• Use the Service to scrape or crawl websites in violation of their terms of service or robots.txt directives.
• We reserve the right to suspend access for violations of this section.

The Service, including its design, code, branding, and documentation, is owned by PageBrain and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

You retain full ownership of any data you generate using the Service. We claim no rights over your crawl data, reports, or exports.

PageBrain is local-first - crawl data is processed and stored on your device. Our collection and use of personal information is governed by our Privacy Policy. By using the Service you acknowledge that you have read and understood the Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.

To the maximum extent permitted by law, PageBrain and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless PageBrain and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and notify you via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
